Dutch Regulator OPTA Fines SMS spammers

Opta, the Dutch telecoms regulator has imposed the first fines for spam with the highest fine EURO 42.500.

Opta was established on the basis of complaints which have been lodged on the Internet site www.spamklacht.nl.

The fine of EURO 42,500 were imposed on persons involved in spam.

In one case, a fine of EURO 20,000 was imposed on Yellow Monday, acting under the name ‘Purple Friday’, at Etten-Leur, which sent spam SMS.

Under use of sms-code 3545, SMSs were sent without the recipient having granted authorisation. The recipient was charged EURO 1.10.

With the coming into force of of new telecommunication law on 19 May last the task OPTA Dutch fight senders has got of spam. To collect complaints OPTA by that date the Internet site has opened www.spamklacht.nl, on which until now wide 6000 complaints have been received.
